Revised Redacted Material

Pursuant to the Gaming Facility Location Board's 2023 Request for Applications:

“Applications, Supplements and associated materials will be treated as public records and, as soon as possible after both Return Dates, will be posted online for public review, with redactions of language exempt from disclosure pursuant to New York State’s Freedom of Information Law (FOIL).” ... “Redactions or excisions should be employed only in accordance with these specific exemptions from disclosure per FOIL.

All determinations concerning whether Applications, Supplements and/or associated materials submitted in response to this RFA are subject to disclosure under FOIL will be made by the Board or the Commission, as applicable, in their sole discretion. The Commission procured the services of a FOIL counsel to review redactions to ensure they are appropriate, including the trade secret process outlined in POL § 89(5)(b).

Updated records are being uploaded adjacent to (not replacing) existing redacted records on each project’s Application Materials page as they become available. As of May 2026, more than 450 such records, denoted with “REVISED REDACTIONS” suffixes, have undergone the statutory review process, are considered final, and have been posted online.

Interested parties may wish to check the website periodically as revised records are being uploaded in batches as they emerge from the statutory review process. The Commission conservatively estimates to be complete with the review of all Applicants’ material by mid-Summer 2026.

As of May 5, 2026, the following Hard Rock Metropolitan Park records denoted with “REVISED REDACTIONS” suffixes have undergone the statutory review process, are considered final, and are posted below.
